In the event of inconsistency, the terms of the applicable agreement shall prevail over these Terms. These Terms are supplementary to the Account Agreement between you and the Bank.
1.6. In the event of a conflict between these Terms and the Account Agreement, these Terms shall exclusively prevail regarding your use of the Site, whereas the Account Agreement shall take precedence in all other matters.
1.7. Terms not defined herein shall bear the same meaning as in the Account Agreement.
1.8. These Terms should be read in conjunction with any terms, conditions, and disclaimers provided on the Site’s pages, which, in case of any inconsistency, shall supersede these Terms. The Terms, information, material, and content presented on the Site's pages are subject to change without prior notice by updating this posting. Your continued access or use of the Site implies your acceptance of any changes.
1.9. Brighty refers to the mobile application owned by the legal entity Razz Finanzz AG, with registration address at: Mühlegasse 18, Baar, Zug, Switzerland, 6340.
2. USERS OF THIS SITE
2.1. The Bank owns, operates, manages, and issues the Site and is licensed for banking operations by the Financial Services Unit of the Commonwealth of Dominica. The Site primarily targets users accessing it from outside the Eastern Caribbean Currency Union. Consequently, we cannot ensure that the Site or its content complies with the laws or regulations of other countries or is suitable for use in other regions.
2.2. You are solely responsible for any individual using your computer to access the Site and must ensure their compliance with these Terms. The information provided on the Site is not intended for distribution to, or use by, individuals in jurisdictions where such distribution or usage would contravene law or regulation. 6. CONTACTING US ONLINE
6.1. Existing clients can use our internet banking service's Contact Centre to send us messages securely. If you are not currently using our Internet Banking service or are not a client of the Bank, you can contact us via email at info@nodabank.com, though email communication is less secure than using the Contact Centre.
6.2. In the case of reporting a security breach or concern, contact the bank by telephone and confirm in writing via email to info@nodabank.com from the email account linked to your Account.

8. CREDIT
8.1. Credit and mortgage facilities may be available from the Bank, subject to status and security. Detailed information on credit facilities is accessible upon request, and it is advisable to contact us through the Contact Centre for mortgages or other secured loans.
8.2. Failure to maintain repayments on a mortgage may result in repossession of your property.
8.3. Any Bank Debit Card or Credit Card issued by the Bank is a regulated product.
9. NO OFFER
9.1. Nothing on this Site constitutes a solicitation or offer to acquire or dispose of any investment. It is not intended to serve as the basis for an investment decision and should not be relied upon in any manner. The Site does not provide investment advice or recommendations regarding buying or selling investments or securities.
10. PRODUCTS AND SERVICES
10.1. The availability of the Bank's products and services depends on securing and/or maintaining correspondent bank facilities and/or commercially viable insurance. Consequently, products, services, or features of the Bank's platform may be temporarily or permanently unavailable in certain markets, requiring potential restructuring.

11.2. The Bank provides an investment functionality through which Brighty users can utilize Nodabank's asset management license. This functionality allows Brighty users to engage in asset management services under the regulation and oversight of Nodabank’s licensure.
12. CRYPTO AND DIGITAL CURRENCY
12.1. Trading or holding Crypto and/or Digital Currency carries substantial risk. Before engaging in such activities, carefully consider whether it is suitable for your financial situation.
13. TAX
13.1. Banking offshore may offer potential tax benefits, but tax regulations vary by country. Seek professional tax advice if unsure about your tax obligations, as disclosing income to tax authorities is your responsibility.
13.2. Tax advice on this Site is based on current and proposed legislation and practice and should not be construed as legal or tax advice.
14. NO WARRANTIES
14.1. The following clauses limit our legal liability for the Site, and they apply to the extent permitted by law. We do not exclude or restrict statutory obligations under the laws of the Commonwealth of Dominica. 17.2. The Bank does not endorse social media sites or third-party content posted on them. Investment or tax advice is not provided via social media. Personal data shared on social media may be stored outside the Bank's control and accessible to the public.
17.3. Social media is not an appropriate platform for discussing confidential information, and the Bank may delete posts to protect confidentiality.

19. GOVERNING LAW
19.1. The contract with the Bank is governed by the laws of the Commonwealth of Dominica. The terms and conditions of the contract are in English, and communication will be conducted in English. Disputes will be resolved through our support team, as there is no banking ombudsman or financial compensation scheme in the Commonwealth of Dominica.
